Russian Certification Laws

Certification of products

The laws of the Russian Federation stipulate mandatory certification of products. The law of the Russian Federation "On Certification of Products and Services" defines certification as the procedure whereby an organization, which is independent from the manufacturer (seller) and consumer (buyer), establishes the conformity of specific products to the existing requirements".

Depending on the requirements to a specific product, the certification may be mandatory or optional.

The government of the Russian Federation maintains and updates from time to time the official list of products, which are subject to mandatory certification. By obtaining optional certification of the product, the manufacturer (seller) can improve his competitiveness, and offer additional proof of quality to the consumer (buyer).

Export of products to the Russian Federation is governed by the law of the Russian Federation “On Protection of the Rights of Consumers”, adopted in February, 1992 . This law is aimed at regulating relationship between consumer and manufacturer. It establishes the rights of consumers to purchase the goods of the appropriate quality safeguarding life and health, as well as provides a set of requirements to ensure the state protection of, and remedies available to, consumers.

In particular, the Law “On Protection of the Rights of Consumers” emphasizes that the right to safety of the goods (works, services) for life, health of the consumer, and the environment and the principle of not causing harm to the property of the consumer, are its two key objectives. The law goes further by specifiying that the basic requirements to safety of life, health of the consumer, and the environment are defined in the appropriate norms, rules, regulations and other documents. These documents include but are not limited to: Standards of GOST, Sanitary Rules and Norms (SanPiN), Building Norms and Rules (SNiP), rules, norms and instructions of the State Technical Tupervision Authority of the Russian Federation.

Quite often, a foreign exporter fails to find out about and obtain the necessary certificates before shipping product to Russia. This inevitably leads to problems at the Russian Customs Service, who is in charge of the initial control of imported products and is required by the law to demand the certificates on any merchandise, even on prototypes and samples.
